Is Sofia Vergara‘s extremely lengthy legal battle finally over? A Los Angeles court ruled in her favor in her extended court case against her ex fiance Nick Loeb over custody rights to frozen pre-embryos they made together during the course of their relationship.

After their lengthy legal battle, which has been going on since shortly after their 2014 breakup, the court sided with Sofia against Nick‘s desire “to create a child without the explicit written permission of the other person,” People reports.

Nick originally sued Sofia back in 2015 over the embryos they created when they were together. The suit asked that Nick be given full custody of the fertilized eggs so that he could have them implanted in a surrogate and so that they could have a trust fund set up for them. They both publicly spoke out with their sides of the story separately.

Sofia Vergara and her ex Nick Loeb‘s frozen embryo battle has been thrown out by the judge, TMZ reports.

The 45-year-old actress was sued by her frozen embryos – as plaintiffs “Isabella” and “Emma” – late last year.

Nick originally sued Sofia back in 2015 over the embryos they created when they were together.

The suit asked that Nick be given full custody of the fertilized eggs so that he could have them implanted in a surrogate and so that they could have a trust fund set up for them.

The judge reportedly stated that Nick has no business suing her in Louisiana because the embryos were conceived in California, and neither parent has any permanent ties there.

The judge noted that Nick likely only filed in Louisiana because of its favorable laws regarding the rights of unborn children.

The judge also stated that the case would probably have required a constitutional evaluation of the embryos’ rights.

Sofia has previously filed docs asking the court to end the embryo battle. It is unclear whether or not Nick intends to refile.

The 44-year-old actress is currently being sued by her frozen embryos – as plaintiffs “Isabella” and “Emma” – according to Page Six.

The alleged suit asks that Nick be given full custody of the fertilized eggs so he can have them implanted in a surrogate and so the plaintiffs could receive a trust fund set up for them.

Nick originally sued Sofia back in 2015 over the embryos they created when they were together. Nick then shared plans that he wanted to become a single father.

The frozen embryo battle between Sofia Vergara and Nick Loeb is continuing – and it’s getting heated.

“I really want to make this, like, the last time I talk about it because I don’t think it’s fair,” Sofia, 42, told ABC News. “I promote all my movies, all my work, but I don’t like promoting my private life and I don’t understand why this person…I don’t want to allow this person to take more advantage of my career and try to promote himself and get press for this.”

“It shouldn’t be out there for people to give their opinion when there’s nothing to talk about,” Sofia said. “There’s papers signed. There is a court date. He shouldn’t be creating something so ugly out of nothing.”

Meanwhile, Nick went on the Today show this morning (May 7)

“Do you want to have a baby or do you want to have her baby?” Hoda Kotb smartly asked Nick. “It has nothing to do with a baby or her baby…Lives were created,” he said.

The 42-year-old actress appeared on The Howard Stern Show and opened up for the first time about the battle of her embryos with ex-fiance Nick Loeb.

“I totally understand him, but the thing is this. Fortunately, and unfortunately, there is law. You signed legal papers and if it was so serious for him, this issue, which I totally respect if it’s serious for someone, then you should’ve taken it more serious like I did,” Sofia said. “There is a contact. He can’t do anything… We did it two times.”

Sofia also said that a baby needs “more than a mother, [a baby] needs a loving relationship of parents that get along, that don’t hate each other.”

Nick Loeb has written an op-ed piece in the New York Times detailing his court case, his beliefs about the frozen embryos he created with ex fiancee Sofia Vergara, and their relationship together.

The 39-year-old businessman also goes into detail about his reason for splitting with the 42-year-old Modern Family star.

“In my view, keeping them frozen forever is tantamount to killing them,” Nick writes in the op-ed. “I take the responsibility and obligation of being a parent very seriously. This is not just about saving lives; it is also about being pro-parent.”

“Many have asked me: Why not just move on and have a family of your own? I have every intention of doing so. But that doesn’t mean I should let the two lives I have already created be destroyed or sit in a freezer until the end of time,” Nick continues.
